Ohio gas prices up slightly this week

COLUMBUS, Ohio (AP) ? Ohio drivers can expect to pay about a penny more per gallon at the gas pump this week.

The average price for a gallon of regular gas was $3.46 in Monday's survey from auto club AAA, the Oil Price Information Service and Wright Express. That's up slightly from about $3.45 last week.

A year ago, the average in Ohio was $3.68.

Nationally, the average price for regular gas is about $3.49, about 2 cents higher than last week. The national average last year at this time was $3.71.

U.S. oil supplies swelled in June to 22-year highs but have declined since then.

North Carolina DWI Stops | N.C. DWI 'Blood Cases' | Legal Shield ...

So today?s Raleigh DWI Attorney blog is going to deal with what happens when an individual facing a North Carolina DWI Charge
either refuses to blow in the Intoxilzyer or are unable to and the
State elects to draw the Defendant?s blood to test for their
blood/alcohol concentration.

Commonly referred to as a ?blood case? these type of DWI?s have some
interesting ins and outs for a Raleigh DUI Lawyer or any other North Carolina DUI Lawyer.
But, this blog post is not intended on covering all the issues that
can come up with blood cases. No, today?s blog post is going to deal
with my frustration with the handling of these particular types of
cases.

You see, with blood cases in North Carolina, the blood is shipped off to
the State Bureau of Investigation (SBI) to have then run the test to
determine the Defendant?s blood/alcohol concentration. In many of these
types of North Carolina DWI cases, is very important to the State?s
case against the Defendant. However, the blood can take months for it
to get back to the District Attorney?s office. Since the State is
reluctant to proceed without the blood results, they will continue the
case multiple times until the blood results comes in.

Now, as a Raleigh Criminal Attorney and Raleigh DWI Attorney,
I am no stranger to continuances. In fact, both the Defense and the
State will utilize continuances in order to get time to get their
evidence together, work out pleas, etc. What my big frustration is that
there seems to be a double standard in some counties when it comes to
blood cases.

You see, for some counties in the Research Triangle Area, DWI cases are
required to be resolved very quickly. If the case is several months
old, the Defense may not be granted a continuance, regardless of the
reason for the motion to continue. Now, some attorneys may be asking
for a continuance for selfish reasons, others may have legitimate
reasons, like a necessary witness isn?t available that day, or the
Defendant needs more time to complete their Substance Abuse Assessment,
get money together, or make arrangements should they be facing jail
time. Regardless, if the case is outside the predetermined limitations
for DWI Cases, the Judge can deny the Defendant?s motion and they are
forced to proceed.

Now, shift gears to a blood case. In these same counties (one in
particular comes to mind ? though will not be named) if the DWI is a
blood case, the State is given all the time in the world to get their
evidence together. Now, I understand the District Attorney?s office has
their hands tied because they can?t control the SBI, but that doesn?t
change the fact that the Defendant is being required to come to court
multiple times on something they have been accused of (but not yet
proven) in violation to their right to a speedy trial. As example, I
was in this particular county this morning for a client who was charged
with a North Carolina DWI November 6th. This client has had 5 court
dates since that time, each time having to have a relative take off of
work and drive them to court as they can?t drive themselves. The Judge
today granted State?s motion, over my vigorous objection, but did mark
the shuck last (meaning the State is not suppose to get another
continuance on the new date).

Now, some may say, what?s a few months of waiting, the State needs to be
able to convict these people and need these blood results in order to
do it. But keep in mind, these individuals have only been ACCUSED of a
crime. Though a Police Officer was suppose to determine that they had
probable cause to charge the individual, that is not necessarily enough
for a conviction. What if these blood results came back as a .02?
Would you still feel it?s appropriate that the State require these
individual come to court five, six, eight times, take at least an hour
at a time to figure out what is going to be done with the case, only to
learn that there was not enough evidence to charge them, let alone
convict them? There is good reason we have a Constitutional Right to a
speedy trial, so that the State cannot bring charges and then make the
Defendant wait around, and come to court under threat of arrest, until
the State can make their case.

Dust to Dust: Darksiders II finds its spirit animal

At four times the size of the first game, Darksiders II is big enough to make the most committed gamer break out in a bit of a sweat. Don?t be daunted; a little bird is here to help you find your way.

The follow up to 2010?s Darksiders, Vigil?s debut title and a brand new IP.

Set in the same time frame as the original game; both War and Death are on a quest to prove War?s innocence in the triggering of the apocalypse which wiped out humanity.

Death is faster and more nimble than his solid brother and has access to a whole new array of tools.

One of the key new features is random loot, which provides a stronger RPG element to building your version of Death.

At a preview event last week I choked on the output of a fog machine, so THQ quietly let me sit down and play Darksiders II undisturbed for a couple of hours, perhaps as an apology for nearly letting me meet the actual grim reaper. Having seen all the cutscenes already and being a power gamer of the finest calibre (read: knows how to force-skip dialogue), I managed to get well past the opening section press had previously been allowed to come to grips with at E3, and complete not just the entire Crowfather world but the first two dungeons (of what looked like about six) of The Forge Lands.

It was only when I ran up against a boss I didn?t know how to beat ? probably the answer was in one of the dialogue bits I skipped ? that I remembered I had to go back to work at some stage. Otherwise, I think I might have been sitting there until THQ hit me over the head with a shovel and dragged me away. It?s not just that there didn?t seem to be any reason to stop; it?s that Darksiders II is huge. The map I reached at the preview event is just one of four worlds, each of which, according to Vigil, is the size of the original Darksiders. The very first activity the player performs as War?s brother Death is not to bash something up but to get on a horse and ride down a long winding path admiring the grandiose scenery and orchestral soundtrack. Not only does this immediately set the tone for what turns out to be a high-fantasy feeling very distinct from the first game?s atmosphere, it also gets you used to the idea of scale before you have to look at the overmap and have some kind of panic attack.

When I did get around to looking at the map of the first true world, The Forge Lands, it was after exploring the first town hub ? a dauntingly large area in and of itself ? and passing through a short navigational segment between me an the open plains. And I do mean open. Directly opposite me, sprawled between cliffs, was some sort of enormous tentacley eyeball thing which later research tells me was a form of Corruption, blocking my path to the Tree of Life, which connects the four realms. Apart from this obvious end goal, the pleasantly green landscape just spread out in front of me, dotted by paths snaking off in six directions.

Two minutes of pure gameplay.

Although the build I had didn?t do much to explain it, I discovered Death is accompanied by a raven named Dust. This handily green-highlighted companion is like an objective marker you can yell at; tapping the left analog stick down caused Death to bark a resentful order to the bird, which flew off in the general direction of the next goal. Out on the overmap, it was easy enough to find the path ? a gentle five-minute canter over the bodies of enemies through a good four different environments ? but in the dungeons, Dust became really valuable, highlighting the presence of levers, doors, ledges and other puzzle components.

I?m a little afraid of puzzles. I was raised on a diet of Tomb Raider, where when you walked into a cavernous room and the camera peeled off to the sound of some chanting monks you knew you were in for it and promptly called in someone better at basic logic. Vigil is far less fiendish than the old Core team in that it doesn?t require you to pull levers in the Fibbonaci sequence (or whatever), and most of the time it?s clear where you have to go and what you have to do ? even if actually achieving it is another matter. But when the dungeons are so large, and each one is a slice of a larger questline in a game of about 40 hours, you really don?t won?t to be bothered with going through the wrong door, hitting a dead end, and back-tracking. Send Dust to perch over the right corridor entrance, than hie yourself down it and solve the puzzle at the other end.

Loot, skill trees and magic.

With this simple little tool, Vigil has taken much of the pain out of what might otherwise prove to be too much game for the average pundit to handle. Completionists and trophy hounds are going to love the optional side-dungeons and ferreting out every single hidden treasure chest, but for those of us who just want to smack monsters, zip around dungeon walls like the world?s only attractive spider, and stare in horrified confusion at lever arrays for four hours before realising the door is behind them, that helpful little purple map marker and green glow make the world of difference. Darksiders II is shitting ginormous, and I?ll take any shortcut to the action I can find.

Darksiders II arrives on PC, PlayStation 3 and Xbox 360 on August 14 in the US and August 21 in Europe. A Wii U version is expected to follow.

TSX halts slide as miners rally on stimulus hopes

TORONTO (Reuters) - Canada's main stock index halted its three-day skid on Wednesday, rising with mining shares as investors were hopeful that deteriorating global economic conditions would spur stimulus moves by central banks in the United States and Europe.

Weak data from the United States and Europe raised expectations the Federal Reserve and European Central Bank would announce more monetary easing measures when they hold meetings next week.

ECB Governing Council member Ewald Nowotny said there were arguments for giving Europe's new permanent rescue fund a banking license, enabling it to borrow unlimited central bank money and so boosting its capacity to prevent the crisis from spreading.

"We've seen this phase for the past couple summers, where the economic data starts coming in a little bit weaker and the market turns to central banks for more gas in the engine," said Craig Fehr, Canadian market strategist at Edward Jones in St. Louis, Missouri.

The news was welcomed by Canada's beaten-down materials sector, which climbed 1.5 percent as gold mining stocks rallied with bullion prices.

Top gold producers led the way, with Goldcorp jumping 3.5 percent to C$34.84 and Barrick Gold up 2.2 percent at C$34.49.

Energy shares also turned higher, edging up 0.1 percent as oil prices rebounded on increased Middle East turmoil and hopes for further Fed stimulus.

Suncor Energy -- Canada's largest oil producer -- led gains, rising 3.7 percent to C$30.87 a day after reporting a 28 percent jump in second-quarter profit. The company also said on Wednesday it will no longer commit to an ambitious growth program that had troubled some shareholders.

Oil gains were nearly offset by weak earnings from Cenovus Energy , whose shares slid 3 percent to C$31.15 after the oil firm reported a 40 percent drop in second-quarter profit and called off its search for a partner to help develop the Telephone Lake oil sands project in Alberta.

TransAlta Corp shares tumbled 3.5 percent to C$15.60 after the oil and gas firm said it estimates a loss in the second-quarter compared with a year earlier.

The Toronto Stock Exchange's S&P/TSX composite index <.gsptse> ended up 25.56 points, or 0.2 percent, at 11,492.51.

In the latest sign the American recovery was faltering, data on Wednesday showed U.S. single-family home sales in June fell by the most in more than a year.

In Europe, German business sentiment dropped to its lowest level in over two years, reinforcing the view that even the euro zone's biggest economy was being damaged by the debt crisis.

The news comes on the heels of a decision by ratings agency Moody's Investors Service to revise Germany's credit outlook to negative from stable.

"It looks like Germany will avoid a recession, but the question is for how long?" said Pat McHugh, Canadian equity strategist at Manulife Asset Management. "The economic news just keeps getting worse."

Canada's powerhouse financial services sector led declines, dipping 0.4 percent. Leading losses was Royal Bank of Canada , down 0.8 percent to C$50.39, Bank of Nova Scotia , off 1.1 percent at C$50.61, and Toronto-Dominion Bank , which sagged 0.4 percent to C$78.08.

WEAK EARNINGS

Second-quarter earnings from Canada's largest diversified miner, railroad and grocery store chain also failed to excite.

Teck Resources Inc plunged 7.3 percent to C$27.27 after the miner said lower coal and metal prices contributed to a steeper-than-expected drop in quarterly profit and that it sees no reprieve anytime soon.

Shares of Loblaw Cos Ltd fell 1.5 percent to C$31.45 after the grocer reported lower quarterly profit on Wednesday, as sales growth lagged an increase in expenses.

Even Canadian National Railway Co , which reported a 17 percent rise in second-quarter profit, saw its shares slide 0.5 percent to C$86.83.

However, shares of Canadian Pacific Railway , CN's main competitor, jumped 5.2 percent to C$78.97 after reporting its second-quarter net income rose to C$631 million from C$538 million a year earlier.

While mostly disappointing, Edward Jones' Fehr said the earnings were consistent with the "sluggish" economic backdrop.

"The market is readjusting to the new earnings growth pace that we're likely to see for the next couple of quarters," he added.

Warner Bros. plans to move "Gangster Squad" to January

NEW YORK (TheWrap.com) - Warner Bros. is planning to move the release date of "Gangster Squad" from September 7 to January, according to individuals with knowledge of the situation.

Other reports have pegged a specific date - January 11 - but neither our sources nor the studio would confirm that. Nor would the studio confirm whether a scene in which gunmen shoot up a movie theater would remain in the film.

The scene was in the film's trailer - which screened before "Dark Knight Rises" and has been replaced since the Colorado shooting - but has been removed.

The film, directed by Ruben Fleischer and written by Will Beall, stars Ryan Gosling, Sean Penn, Josh Brolin and Emma Stone. It chronicles a coterie of LAPD cops who try to take down Mickey Cohen, a notorious Los Angeles gangster.

Ever since a gunman, suspected to be James Holmes, killed 12 and injured 59 at showing of "The Dark Knight Rises" just past midnight last Thursday night, Warner Bros. has been working around the clock to figure out what to do with "Gangster Squad."

Given the tragedy in Aurora, which also occurred in a theater, individuals close to Warner Bros. have said for a few days the studio would remove the scene from the movie and push its release date both to allow for reshoots and distance the film from the real-life shooting.
